Raich a bait & switch?

I'm late in arriving today because I've been busy at Last One Speaks posting about the other war - the one on some drugs. The Raich decision came down today and the email alerts were just pouring in. Although the outcome was expected, the decision arrived in a surprising package. Oddly it was the conservative judges who dissented.

I think it's all a ploy to confuse the judicial appointment brouhaha that will surely develop when Rehnquist steps down. They had nothing to lose by dissenting and it makes a pretty good case that conservative judges can be impartial and open-minded. Maybe I'm just feeling bitter tonight but it feels like a trick to me.
